Trial Dates Set for Macy’s in Martha Stewart-J.C. Penney Dispute

NEW YORK-The New York State Supreme Court in Manhattan has scheduled the trial dates for the two lawsuits Macy’s has brought against Martha Stewart Living Omnimedia (MSLO) and J.C. Penney over their plan for Martha Stewart home shops in J.C. Penney stores and a website for Martha Stewart home products.

The case of Macy’s v. Martha Stewart Living Omnimedia has been scheduled to go to trial on Feb. 19. The other case, Macy’s v. J.C. Penney, has been slated for March 4.

MSLO and J.C. Penney announced their collaboration in December 2011, calling for shops and a dedicated website offering Martha Stewart home and lifestyle products. Macy’s—which has held the rights to Martha Stewart-branded cookware, kitchen utensils, bedding and bath products since 2007—filed suit against MSLO in January 2012, and then sued J.C. Penney separately last August. Along with its suit against MSLO, Macy’s renewed its agreement with Stewart’s program to run until January 2018.

The J.C. Penney shops with Martha Stewart products are slated to open next month.
