Spring Air Employee Files Class-Action Suit Against Company Over Termination

TAMPA, Fla.–A former employee of Spring Air, which closed its manufacturing facilities last week, has filed a class-action suit against the mattress manufacturer.
In a filing in U.S. District Court here, Jared Azzata, a sales representative for Spring Air, said the company terminated him and about 1,000 employees without cause, and closed the company plants without a 60-day advance written notice as required by the U.S. Worker Adjustment and Retraining Notification (WARN) Act of 1988. Azzata is seeking an amount equal to the total of unpaid wages, salary, commissions, bonuses, accrued holiday pay, accrued vacation pay, pension, 401(k) contributions and other benefits for 60 days, which he said the employees are entitled to under the WARN act.
A call to American Capital, Spring Air’s owner, for comment on the suit was not returned.
